1Acceptance of Terms
By installing or using Vivm, you agree to this User Agreement. If you do not agree,
do not use the app.
2License to Use Vivm
Subject to this User Agreement and applicable platform terms, Vivm grants you a
limited, non-exclusive, non-transferable, revocable license to use the app for personal
and lawful creative purposes on devices you own or control.
3Eligibility and Device Requirements
- You must use Vivm in compliance with applicable law and the rules of the app marketplace through which you obtained it.
- You are responsible for maintaining a compatible device, system software, and any permissions needed for features you choose to use.
- If you are using Vivm on behalf of an organization, you represent that you have authority to bind that organization.
4Your Content
- You retain ownership of the photos, layouts, templates, titles, subtitles, and other content you create or import into Vivm.
- You are responsible for ensuring that you have all rights needed to import, edit, store, export, and share your content.
- You grant Vivm a limited permission to process your content on your device as needed to provide saving, rendering, exporting, duplication, and template functions that you initiate.
5Acceptable Use
- You may not use Vivm to violate law, infringe intellectual property rights, invade privacy, harass others, or distribute unlawful or harmful material.
- You may not interfere with the app, reverse engineer the app except where non-waivable law allows it, bypass purchase mechanisms, or attempt unauthorized access to systems or data.
- You may not misrepresent coin balances, purchase status, authorship, or the source of exported materials.
6Local Storage, Export, and Sharing
- Vivm is designed as a local-first app, and most project data remains on your device unless you choose to export, share, or contact support.
- When you export or share content, you are responsible for the destination, recipients, and any public or third-party disclosure that follows.
- You should maintain your own backups if your creative work is important to you.
7Permissions and Platform Features
- Some features require access to the photo library, system share sheet, App Store services, or other iOS framework features.
- The app may present Apple's App Tracking Transparency permission prompt as part of the current app flow.
- If you deny a permission, some features may be limited or unavailable.
8Coins and In-App Purchases
- Vivm may offer optional consumable in-app purchases in the form of coin packs that unlock premium local editing actions.
- Coins are non-transferable, have no cash value, are not a deposit account, and may be used only inside Vivm.
- Coin purchases are processed by Apple, not by Vivm directly. Billing, taxes, refunds, and payment methods are handled under Apple's terms and applicable law.
- Core access to your existing saved works is not conditioned on buying coins, although certain optional premium actions may require them.
- Vivm may update pricing, coin packages, premium actions, or availability at any time, subject to applicable law and marketplace rules.
9Updates and Availability
Vivm may release updates, improvements, bug fixes, design changes, feature adjustments,
or legal disclosures from time to time. Some features may depend on Apple services,
device compatibility, or future app versions.
10App Ownership and Intellectual Property
Vivm, including its app design, code, branding, interface elements, and original
product materials, is protected by intellectual property laws. Except for the limited
license above, no rights are granted to you.
11Third-Party Services and Platform Terms
- Your use of Apple services, the App Store, StoreKit purchasing tools, the iOS share sheet, and any third-party destination app is governed by the terms and privacy practices of those providers.
- If you obtained Vivm through Apple, Apple may have rights and obligations required by its marketplace terms.
12Disclaimers
To the maximum extent permitted by law, Vivm is provided "as is" and "as available,"
without warranties of any kind, whether express, implied, or statutory, including
warranties of merchantability, fitness for a particular purpose, title, non-infringement,
uninterrupted availability, or error-free operation.
13Limitation of Liability
To the maximum extent permitted by law, Vivm will not be liable for indirect,
incidental, special, consequential, exemplary, or punitive damages, or for loss of
profits, data, goodwill, or content, arising from or related to your use of the app,
even if advised of the possibility of such damages.
14Termination
- You may stop using Vivm at any time.
- Vivm may suspend or terminate your right to use the app if your use violates this User Agreement, applicable law, or platform rules.
- Sections that by their nature should survive termination will remain in effect, including ownership, disclaimers, liability limits, and purchase-related provisions.
15Changes to This Agreement
We may revise this User Agreement from time to time. The updated version becomes
effective when posted with a revised "Last Updated" date. Continued use of Vivm after an
update means you accept the revised terms.
